Terms & Conditions – Fertility Retreats Ltd

Thank you for considering using Fertility Retreats Ltd to help you during your fertility journey.

Fertility Retreats Ltd offers Fertility Wellness Retreats which have been designed to help you fully relax your mind body and soul, find emotional balance and self-care, and leave you feeling completely relaxed with a more positive mindset, wherever you are in your fertility journey.

This document is herein referred to as the “Terms and Conditions” and forms the entire agreement between the Client and Fertility Retreats Ltd. Headings in this document are used for convenience only.

Definitions

In this document, unless stated otherwise, the following expressions have the following meanings:

Booking – A Booking made by the Client on the booking page of the website belonging to Fertility Retreats Ltd in respect of booking a Fertility Wellness Retreat.

Contract – The agreement entered into between Fertility Retreats Ltd and the Client at the time of the Booking are governed by these Terms and Conditions.

Client/You – The individual, group or Company that makes a booking with Fertility Retreats Ltd.

Fee – The full amount payable to Fertility Retreats Ltd at the time of Booking.

Force Majeure – Any act, event, omission, or accident beyond the reasonable control of Fertility Retreats Ltd. This includes but is not limited to; acts of God, war, riot, civil unrest, compliance with laws and regulations, accident, pandemic, fire, flood, storm, adverse weather, strikes, breakdown of machinery, industrial disputes, or transport.

Host Venue – Grassfield Hall, Low Wath Road, Pateley Bridge, Harrogate, North Yorkshire HG3 5HL

Partner Providers/Third Party Providers – Companies or individuals who provide services during a Fertility Wellness Retreat who are not directly employed by Fertility Retreats Ltd.

Fertility Wellness Retreat – As set out on the Fertility Wellness Retreats page of our website.

Services – Those services provided by Fertility Retreats Ltd, their Partner Providers/Third Party Providers at their host venue Grassfield Hall to the Client as identified in the ‘What We Provide To You’ section of these Terms and Conditions and as per the Fertility Wellness Retreat Programme on our website.

Why You Should Read These Terms and Conditions

We encourage all Clients to read these Terms and Conditions carefully prior to booking a Fertility Wellness Retreat. These Terms and Conditions tell you who we are, how we will provide our services to you, and other important information you should be aware of prior to booking a Fertility Wellness Retreat.

Our Aim For You As a Valued Client

The aim of our Terms and Conditions is to ensure that as our valued Client, you are fully informed of your contract with Fertility Retreats Ltd prior and upon booking.

If there is anything we can help you with regarding these Terms and Conditions, then please e-mail info@fertilityretreats.co.uk where a member of the team will be able to help you.

If we need to contact you, we will do so by telephone or by writing to you at the email address or the postal address you provided to us in your booking details. When we use the words ‘writing’ or ‘written’ in these terms, this also includes emails and/or text messages.

We understand that you may experience some degree of vulnerability during your stay at a Fertility Wellness Retreat. To help alleviate any worries and / or concerns, and to answer any queries which you may have during your physical attendance at a Fertility Wellness Retreat, Fertility Retreats Ltd will provide a host who will be available to speak to at the venue and will be able to address any questions or concerns.

Our Fertility Wellness Retreats are not suitable to attend if you have serious medical conditions, including serious mental health issues. We advise that you contact your GP for any serious complex health conditions, and to seek clinical guidance and advice prior to booking a Fertility Wellness Retreat.

What We Provide To You

What we provide to you at each Fertility Wellness Retreat is set out on the Fertility Wellness Retreats page of our website, confirmed on each individual Fertility Wellness Retreat Programme that you have specifically chosen to book, and as stated in the ‘What’s Included During Your Stay’ section of these Terms and Conditions.

Fertility Retreats Ltd may refer anyone who attends a Fertility Wellness Retreat to Third Party Providers / Partner Providers with your permission in line with General Data Protection Regulation (EU)2016/679 (‘GDPR’) and the Data Protection Act 2018, to make available other fertility specialised holistic and wellbeing services to you either before, or after attendance at a Fertility Wellness Retreat. However, we will only do so with your verbal and/or written consent.

Information We Collect From You

We need to collect some information from you in order to be able to provide a Fertility Wellness Retreat to you. It is important that the information you provide to us is correct. We will only use your personal information as set out in our Privacy Policy that is compliant with the General Data Protection Regulation (EU)2016/679 (‘GDPR’) and the Data Protection Act 2018. We are responsible as a ‘controller’ of that personal information for the purposes of those laws.

Disclosure of Your Information To Third Parties / Partner Providers

You agree that we may disclose your information to third parties and partner providers for the delivery of our Fertility Wellness Retreats, including, but is not limited to:

Third parties / partner providers who we use to help deliver our services to you as the Client, e.g. Grassfield Hall, Holistic and Fertility Wellbeing Providers & Organisations, a Fertility Counsellor, Fertility Nutritionist, Fertility Clinics, Fertility Doctors & Consultants, and any other third-party providers deemed suitable and necessary where appropriate.
Anyone that you ask us to communicate with, or provide as an emergency contact, for example your next of kin, legal guardian, or a care provider.
Any other third parties / partner providers we use to help deliver our services to you as the Client, e.g. Holistic and Fertility Wellbeing Providers & Organisations, a Fertility Counsellor, Fertility Nutritionist, Fertility Clinics, Fertility Doctors & Consultants, and any other third-party providers deemed suitable and necessary who are not affiliated with Fertility Retreats Ltd.
Other third parties / partner providers we use to help us run our business, e.g. website hosts, payment providers such as Stripe, Starling Bank, HubSpot our digital CRM System and Xero Accounting.
Any member of Fertility Retreats Ltd.
Any member of Grassfield Hall.
Business partners for the performance of any contract we enter into you with.
Condition of us entering into a contract with you.
If we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our Terms and Conditions to protect the rights, property, safety of Fertility Retreats Ltd (and associated staff), and our Clients then we shall do so. This includes exchanging information with other companies and organisations for the purpose of fraud protection and credit risk reduction.

Information we collect from you that is disclosed to third parties / partner providers to help deliver our services to you as the Client is compliant with the General Data Protection Regulation (EU)2016/679 (‘GDPR’) and the Data Protection Act 2018. We are responsible as a ‘controller’ of that personal information for the purposes of those laws.

We only allow our service providers to handle your personal information if we are satisfied they take appropriate measures to protect your personal information. We also impose contractual obligations on service providers to ensure they can only use your personal information to provide services to us and to you.

When providing your personal information onto third party / partner providers, we will always ask for your consent to share this personal information before doing so.

Please be aware that Grassfield Hall and all other third-party providers we use to help deliver our Fertility Wellness Retreats to you, may need to provide your personal information to their regulators and other associated third parties. You should ensure that you are familiar with all Fertility Retreats Ltd third-party providers and their privacy policies, prior to booking a Fertility Wellness Retreat, as their privacy policies may differ from ours.

Fertility Wellness Retreat – What’s Included During Your Stay

Included at each Fertility Wellness Retreat is stated on the Fertility Wellness Retreats page of our website, confirmed on each individual Fertility Wellness Retreat Programme and as stated in the ‘What’s Included During Your Stay’ section of these Terms and Conditions.

Please be advised our Fertility Wellness Retreats are not suitable for anyone who cannot eat plant based or vegan food. By participating in a Fertility Wellness Retreat, you confirm you are in good health, and have, if necessary sought medical advice confirming you are able to eat plant based or vegan food throughout the duration of your stay.

What’s Not Included During Your Stay

Any additional services that are not listed on the Fertility Wellness Retreats page of our website or on each individual Fertility Wellness Retreat programme are not included during your stay. This includes, without limitation; additional food and drink, any additional spa, holistic and wellbeing treatments (if applicable), additional overnight accommodation at Grassfield Hall (if applicable), and any other additional personal costs incurred such as, without limitation, the purchase of any products or merchandise, or the purchase of any additional holistic wellbeing treatments and services are not included during your stay at a Fertility Wellness Retreat.

All additional costs incurred must be paid directly to Grassfield Hall and are subject to their Terms and Conditions, as well as their Privacy Policy. Further clarification and advice can be sought by contacting Grassfield Hall directly. We ask all Clients to familiarise themselves with Grassfield Hall Privacy Policy and Terms and Conditions prior to booking a Fertility Wellness Retreat.

Grassfield Hall Pictures

Pictures on the Fertility Retreats website of Grassfield Hall accommodation and facilities may vary differently and may not be an exact match of the images on the venue website or other marketing material.

Our Rights

Fertility Retreats Ltd reserves the right to adjust, modify, or cancel elements of the suggested timetable of events contained on each individual Fertility Wellness Retreat Programme without notice which may be due, but are not limited to, emergencies, illness, or travel disruption.

Fertility Retreats Ltd reserves the right to remove any Client who is abusive and / or obstructive to Fertility Retreats staff, Grassfield Hall staff, other Clients that may be staying at Grassfield Hall, and any other third-party fertility and holistic wellbeing professionals who help us to deliver our services to you.

Fertility Retreats Ltd reserves the right to change the start and finish time of a Fertility Wellness Retreat with very little or no notice due to unforeseen circumstances such as, which are not limited to, emergencies, illness, or travel disruption.

Although our Fertility Wellness Retreats are staffed by specialised fertility specialists and holistic & wellbeing providers, we offer no guaranteed outcome of a pregnancy either during or after any Client attends a Fertility Wellness Retreat.

Booking

Bookings for a Fertility Wellness Retreat is on the basis of an all-inclusive package which includes everything as set out on the Fertility Wellness Retreats page of our website, confirmed on each individual Fertility Wellness Retreat Programme and as stated in the ‘What’s Included During Your Stay’ section of these Terms and Conditions, which are confirmed as per person.

You may book additional holistic wellness treatments during a Fertility Wellness Retreat, but only on the basis if these are available and applicable to your stay. However, these are subject to availability and subject to additional costs that are not included in any of our all inclusive Fertility Wellness Retreats. Any additional holistic wellness treatments, merchandise, products, and any other paid services offered by other holistic wellbeing practitioners will need to be paid directly upon booking a Fertility Wellness Retreat to either Fertility Retreats Ltd, Grassfield Hall, or to the individual Holistic Practitioner who is providing the holistic wellbeing treatment.

By making a booking at a Fertility Wellness Retreat, the first named person on the booking agrees on behalf of all persons detailed on the booking that he/she:

Has read these Terms and Conditions and has the authority to and agrees to be bound by them.
Consents to our Privacy Policy and use of personal data and is authorised on behalf of all persons named on the booking to disclose their personal details to us, including, but is not limited to; full name, date of birth, address, mobile telephone number, sexual orientation, and where applicable any special categories data such as information on health conditions or disabilities and dietary requirements.
Agrees that all personal details given at the time of making full payment to be given to Grassfield Hall, all other third-party fertility professionals, and third party holistic & wellbeing professionals that help deliver our services to you by Fertility Retreats Ltd for reservation purposes and is authorised on behalf of all persons named on the booking to also disclose their personal details. This information includes, but is not limited to; full name, date of birth, address, mobile telephone number, sexual orientation, and where applicable any special categories data such as information on health conditions or disabilities and dietary requirements.
Is over the age of 18 years of age.
Accepts financial responsibility for payment of the booking on behalf of all persons detailed on the booking.
Consents to Grassfield Hall Privacy Policy and their Terms and Conditions.

All bookings are subject to availability at the time of booking. We do not guarantee any Fertility Wellness Retreat that we advertise will still be available at the time you wish to book.

By providing us with verbal or written confirmation that you wish to book and attend a Fertility Wellness Retreat, you are requesting us to confirm your reservation and booking on your behalf which includes passing all personal details of those named on the booking to Grassfield Hall, other third party fertility professionals and other third party holistic & wellbeing professionals that help to support and deliver our Fertility Wellness Retreats for reservation purposes.

The price of your booking is per person and includes VAT which is the advertised price indicated on the Fertility Retreats Ltd website. We take all reasonable care to ensure that the price advertised is correct.

All bookings must be paid for in full at the time of booking. Payment can be made by credit or debit card which is made online via Fertility Retreats Ltd website. You are required to make full payment at the time of your booking by transferring the total fee to Stripe, a payment processing platform that Fertility Retreats Ltd uses to allow Clients to process payment safely and securely.

It is important to note that we do not accept payment by Cash, Cheque or by American Express.

Once full payment has been made, you have entered into a legally binding agreement with Fertility Retreats Ltd to attend a Fertility Wellness Retreat at their host venue Grassfield Hall.

Your booking is subject to you reading and consenting to these Terms and Conditions. You confirm that you and all other people within your booking will abide by these Terms and Conditions during your entire stay at a Fertility Wellness Retreat at our host venue Grassfield Hall.

Payment & Cancellation Policy

You are required to make full payment at the time of your booking by transferring the total fee to Stripe, a payment processing platform that Fertility Retreats Ltd uses to allow Clients to process payment safely and securely.by a way of debit or credit card. This payment is made online via our website on the ‘Fertility Wellness Retreats’ page.

If you need to cancel the booking, you can do so by advising Fertility Retreats Ltd in writing by e-mailing info@fertilityretreats.co.uk. Any cancelled booking will be subject to cancellation charges as set out below.

For the avoidance of doubt, the following cancellation charges are based on the number of days before the arrival date of a Fertility Wellness Retreat as specified below:

Cancellation less than 31 days: No refund will be given.

Cancellation between 32 days and 42 days: 50% refund will be given.

Cancellation between 43 days and 56 days: 75% refund will be given.

Cancellation 57 days and over: 95% refund will be given.

Refunds

Fertility Retreats Ltd reserves the right to cancel, modify, or terminate a reservation in the event there are serious grounds for doing so. We will of course contact you should these circumstances arise and handle any losses in line with your legal rights.

If we need to refund you for any reason, we will refund you the price you paid for the booking, subject to our cancellation fees and our cancellation policy as set out in these Terms and Conditions. We will deduct any administration fee that may be due and will refund you the balance by the method you initially used for payment within 14 days.

If Fertility Retreats Ltd has to unfortunately cancel a Fertility Wellness Retreat prior to the commencement date, the Client will be offered an alternative date or a full refund.

Cautionary Deposit / Holding Fee

You may need to pay a Cautionary Deposit or a Holding Fee prior to your arrival at a Fertility Wellness Retreat which is in respect of any possible damage, loss of contents, loss to keys, and excessive or incorrect use of facilities at our host venue Grassfield Hall during your stay at a Fertility Wellness Retreat. This includes, but is not limited to, telephones, internet, furniture and any other amenities/furniture provided by Grassfield Hall.

If taken, the Cautionary Deposit or Holding Fee will be refunded to you once the premises, your room (if applicable) and its contents have been inspected and are deemed to be satisfactory and damage free.

Fertility Retreats Ltd reserves the right to invoice you and/or attempt to charge your credit/debit card details which you provided in order to recover reasonable costs in the event of damage caused at Grassfield Hall which is deemed to be insufficient to repair or replace any damage caused by you.

Holistic Wellbeing Treatments

All Clients attending a Fertility Wellness Retreat will need to complete a Health Questionnaire form which is provided by our holistic wellbeing therapists prior to your stay with us if holistic wellbeing treatments are offered and included as part of our Fertility Wellness Retreats. This form asks health questions our Holistic Wellbeing therapists need to know before providing any treatments to you.

Any Clients who refuse to complete a Health Questionnaire form will unfortunately not be able to receive any holistic wellbeing treatments that are offered and included as part of our Fertility Wellness Retreats as set out on the Fertility Wellness Retreats page of our website, confirmed on the Fertility Wellness Retreat Programme and as stated in the ‘What’s Included During Your Stay’ section of these Terms and Conditions.

By signing the Health Questionnaire form you confirm that you do not have any health concerns that may prevent you from undergoing any holistic wellbeing treatment(s) that are offered and included as part of our Fertility Wellness Retreats as set out on the Fertility Wellness Retreats page of our website, confirmed on the Fertility Wellness Retreat Programme and as stated in the ‘What’s Included During Your Stay’ section of these Terms and Conditions. This also applies to any additional wellbeing treatments you may wish to book that are not included in our Fertility Wellness Retreats.

If any of our Holistic Wellbeing therapists are not able to provide to you any holistic wellbeing treatments that are

offered and included as part of our Fertility Wellness Retreats as set out on the Fertility Wellness Retreats page of our website, confirmed on the Fertility Wellness Retreat Programme and as stated in the ‘What’s Included During Your Stay’ section of these Terms and Conditions, then a suitable alternative holistic / wellbeing treatment of equivalent value will be offered to you. This also includes any additional holistic / wellbeing treatments you may wish to book that are not included in our Fertility Wellness Retreats.

Insurance

Travel Insurance and Personal Accident & Cancellation Insurance is highly recommended prior to making any booking to attend a Fertility Wellness Retreat to cover potential eventualities of you not being able to attend on the designated date.

Special Requests

Any special requests in connection with your stay at a Fertility Wellness Retreat must be advised to us at the time of booking in writing at info@fertilityretreats.co.uk. Fertility Retreats Ltd will endeavour to fulfil any special requests, however we cannot guarantee all special requests will be met.

Minimum Age Requirements / Restrictions

You must be over the age of 18 to attend a Fertility Wellness Retreat.

Assignment to Third Party

If you are unable to attend a Fertility Wellness Retreat yourself, then you are able to nominate a person of your choice to take your place. At this point they accept and adhere to our Terms and Conditions, as well as our Privacy Policy accordingly. They also accept and adhere to Grassfield Hall Privacy Policy and Terms and Conditions.

The named person on the booking agrees to be personally held responsible in paying for the cost of additional services / purchases, and holistic wellbeing treatments that are not included in each individual Fertility Wellness Retreat that Fertility Retreats Ltd offers for themselves and the other person(s) on the booking form. Additional services / purchases and holistic wellbeing treatments must be paid to Fertility Retreats Ltd, Grassfield Hall or to the individual Holistic Practitioner(s) in full at the time of booking as per the ‘What’s Not Included During Your Stay’ section of these Terms and Conditions.

Should the Client seek to assign their booking to a third party, they must first obtain the consent of Fertility Retreats Ltd. Fertility Retreats Ltd reserves the right to refuse an assignment without reason.

Grassfield Hall Policy.

Grassfield Hall, including the gardens, and car park are completely smoke free, which also includes vaping. Further clarification can be sought by contacting Grassfield Hall directly prior to attending a Fertility Wellness Retreat.

An additional ‘deep clean charge’ may apply in the event of any Client found to be smoking or vaping in the bedrooms or anywhere else within Grassfield Hall. It is the responsibility of the Client to pay Grassfield Hall directly for any damage caused by smoking and / or vaping and not the responsibility of Fertility Retreats Ltd.

Any item(s) damaged by neglect, or deliberate action, including, but is not limited to, sheets, quilts, pillows, bathrobes, towels etc, damage caused by application of hair dyes, false tans or cosmetics may be charged by Grassfield Hall. It is the Client’s responsibility to pay Grassfield Hall directly for any damage caused prior to leaving a Fertility Wellness Retreat. Fertility Retreats Ltd are not responsible for this liability.

Dress Code

Fertility Retreats Ltd has no strict dress code. However, we ask all Clients to dress appropriately for a Fertility Wellness Retreat and in accordance with Grassfield Hall expectations, which includes suitable swimwear (if applicable). Further clarification can be sought by contacting Grassfield Hall directly prior to attending a Fertility Wellness Retreat.

Mobile Phones

Mobile phone devices are permitted. However, we ask all Clients to avoid using mobile phones and any other electronic devices where possible during a Fertility Wellness Retreat out of respect for others.

Disruptive Clients

Fertility Retreats Ltd operates a strict ‘zero policy’ towards disruptive Clients. Where a situation may arise, Clients will be asked to leave a Fertility Wellness Retreat event immediately without any refund.

Clients that unfortunately need to leave a Fertility Wellness Retreat event due to illness, family emergencies or for any other reason, will unfortunately, not be entitled to any part refund.

Client Personal Belongings

Fertility Retreats Ltd does not accept any liability or damage to Clients’ personal items during a Fertility Wellness Retreat. Large amounts of cash or valuables will need to be covered by your own insurance and we encourage you not to bring high value items with you to a Fertility Wellness Retreat.

Parking At Grassfield Hall

There is free parking at Grassfield Hall. However, Fertility Retreats Ltd accepts no responsibility for any loss of, or damage to your property, vehicle, or the contents therein, however caused. Further clarification and advice can be sought directly by contacting Grassfield Hall directly.

We strongly advise all Clients to familiarise themselves with Grassfield Hall Terms and Conditions prior to booking a Fertility Wellness Retreat.

Responsibilities of The Client

Each Client is responsible for ensuring the appropriate travel arrangements are in place before booking to attend a Fertility Wellness Retreat. Travel costs to and from a Fertility Wellness Retreat are not included in the cost to attend a Fertility Wellness Retreat and remain the responsibility of the Client. This applies to all named parties on the booking form.

It is each Client’s responsibility to arrive at Grassfield Hall promptly on the day of arrival at a Fertility Wellness Retreat. Each Client will be advised of an arrival time prior to attending a Fertility Wellness Retreat by a member of Fertility Retreats Ltd, which is usually at the time of booking.

Any Client who arrives late for a Fertility Wellness Retreat will not be entitled to any part refund.

It is the responsibility of each Client to inform Fertility Retreats Ltd in writing of any health issues that may make them unsuitable to use any facilities at Grassfield Hall. Failure to do so, may result in the contract being cancelled without a refund. Any Client not able to use any facilities at Grassfield Hall will not be entitled to any part refund.

Our Rights To Make Changes

We may make changes to a Fertility Wellness Retreat itinerary with little or no notice, in the case of:

To reflect changes in relevant laws, guidance, and regulatory requirements.
Client safety requirements.
If a third party / partner provider changes what treatments they offer or how they deliver them.

Your Rights To Make Changes

If you wish to make a change to your booking, please contact us at info@fertilityretreats.co.uk or by calling 07903 523157. We will advise you if the change is possible or not. You have the right to amend your booking providing you give at least 31 days’ notice before the start of your original booking.

There is a £10.00 administration fee (including VAT) per Client for all changes to bookings.

Third Party / Partner Providers

Third parties / partner providers are fully responsible in providing their services to you as the Client when a booking is made via Fertility Retreats Ltd for a Fertility Wellness Retreat. It is not the responsibility of Fertility Retreats Ltd to provide services on behalf of any third party / partner providers who help us to deliver our Fertility Wellness Retreats.

Fertility Retreats Ltd accepts no responsibility for any potential breach of contract by third parties / partner providers who help us to deliver our Fertility Wellness Retreats to you, either before, during or after a Fertility Wellness Retreat booking has been made.

All holistic wellbeing therapies & treatment(s) and other services provided to you by third parties / partner providers either during or after a Fertility Wellness Retreat will be subject to the Terms and Conditions of such third parties / partners providers, under applicable laws, guidance, or regulations, disclaims liability for the performance of such treatments or other services. We strongly recommend that you familiarise yourself with each third party / partner provider’s own Terms and Conditions prior to engaging in their services and also their Privacy Policy.

Competition Entries

These Terms and Conditions serve all competitions hosted by Fertility Retreats Ltd on social media platforms including Facebook, Twitter, LinkedIn, Instagram & TikTok unless otherwise stated.

By entering our competitions, an entrant is indicating their agreement to be bound by these Terms and Conditions, and the Terms and Conditions of all Fertility Retreats Ltd third parties / partner providers.

There is no entry fee and no purchase necessary to enter the competitions. To enter, the participant will be required to engage with a Facebook, Twitter, LinkedIn, Instagram & TikTok post as specified in the competition announcement and rules.

Unless otherwise stated within the competition announcement – a winner, or winners, will be picked entirely at random from the pool of eligible entries within 48 hours of the stated competition closing date/time. The winner will be notified in writing within 5 days.

If the winner cannot be contacted or does not claim the prize within 14 days of notification, we reserve the right to withdraw the prize from the winner and pick a replacement winner.

Entries after the closing date/time will not be valid.

Prizes cannot be exchanged or refunded and there is no cash alternative.

Prizes must be booked and completed within 3 months of notification.

Participants understand and agree that the social media sites which host such competitions (Facebook, Twitter, LinkedIn, Instagram & TikTok) do not in any way sponsor, endorse or administer any of Fertility Retreats Ltd competitions and are in no way associated with Fertility Retreats Ltd, Grassfield Hall, or any of our third party / partner providers who we run competitions with.

By entering a Fertility Retreats Ltd competition, you completely release all social media sites from any liability to the participant arising from or as a result of participant’s participation.

You consent to the Promoter using the images uploaded on its own website and any other social media sites or other media form in perpetuity to promote the brand, Fertility Retreats Ltd.

The competition and these Terms and Conditions will be governed by English law and any disputes will be subject to the exclusive jurisdiction of the courts of England.

Email Marketing Campaigns

We may use your personal information to send you updates by email about our services, including exclusive offers, promotions, surveys, competitions, newsletters, or new services. This information may also include information pertaining to third-party providers who help us to deliver our Fertility Wellness Retreats to you.

We have a legitimate interest in processing your personal information for promotional purposes if you have consented to receiving such material via the Contact Us page of our website. However, where consent is needed, we will ask for this consent separately and clearly.

We will always treat your personal information with the utmost respect and never share it with other organisations for their own marketing purposes.

You have the right to opt out of receiving promotional communications at any time by writing to us at info@fertilityretreats.co.uk.

We may ask you to confirm or update your marketing preferences if you instruct us to provide further services in the future, or if there are changes in the law, regulation, or within the structure of our business.

Intellectual Property

The content of our website – www.fertilityretreats.co.uk is protected by copyright, trademarks, database rights and other intellectual property rights.

All intellectual property rights included in our Fertility Wellness Retreat events, all Information associated with our Fertility Wellness Retreat programme, our brand, and the Fertility Retreats logo throughout the world (“our IPR”) belong to us.

You have no intellectual property rights in, or to, our IPR other than the right to use them in accordance with these Terms and Conditions.

The logo and branding of our third party / partner providers and any other business partners who Fertility Retreats chooses to engage with are trademarks and/or owned by such parties.

Media and Marketing

Fertility Retreats Ltd reserves the right to take photographs of the Client during their stay at a Fertility Wellness Retreat only after written and signed permission has been sought. The Client accepts that all rights whatsoever arising from these photographs shall be owned by Fertility Retreats Ltd and may be used for marketing purposes on Fertility Retreats Ltd website, and social media platforms such as Facebook, Twitter, LinkedIn, Instagram & TikTok.

Complaints Procedure

All complaints should be addressed to Sarah Day in writing at info@fertilityretreats.co.uk. Fertility Retreats Ltd will endeavour to respond and resolve all complaints within 15 working days of receiving such complaint.

Force Majeure

Force Majeure events cover acts of God, flood, drought, earthquake. a pandemic, epidemic, civil war, civil commotion, natural disasters, nuclear, chemical, or biological disaster, or any law or action taken by the countries governing body, or public authority, strikes, industrial action or non-performance by suppliers or subcontractors.

Under the Force Majeure event, if Fertility Retreats Ltd is prevented from operating our business under our normal Terms and Conditions, we will not be liable for any breach of contract, or for any such delay in the performance of our obligations, which will not affect or terminate the termination of our contract with you.

If the Force Majeure hinders in any way our ability to deliver on the commitments of your booking more than 60 days prior to your arrival date, you are entitled to cancel your booking which may be subject to cancellation charges as set out in these Terms and Conditions.

If the Force Majeure hinders or affects your booking in any way, within 60 days of your arrival date, no refund will be due to you. However, Fertility Retreats Ltd will offer an alternative date to re-book your stay with us, which once re-booked, will be subject to our normal Terms and Conditions.

Other Important Terms

It is important that you understand that Fertility Retreats Ltd is not a Fertility Medical Centre, or a Fertility Clinic. Our Fertility Retreats Host and third party / partner providers who help us to deliver our services to you are not Fertility Nurses or Fertility Doctors/Consultants.

By attending a Fertility Wellness Retreat, you and all parties named on the booking form understand that by attending a Fertility Wellness Retreat does not guarantee the chance of a pregnancy or becoming pregnant in the future. Whilst our specialised fertility holistic wellbeing third party / partner providers will help and support you during your stay at a Fertility Wellness Retreat, the holistic and wellbeing treatment(s) and sessions provided to you during your stay at a Fertility Wellness Retreat are provided for recreational and relaxation purposes only.

These Terms and Conditions

We may amend these Terms and Conditions from time to time. Please note the date at the bottom of these Terms and Conditions to see when they were last updated.

These Terms and Conditions come into force at the time of your booking, and will apply to the Agreement between you and Fertility Retreats Ltd.

We may revise these Terms and Conditions from time to time to reflect changes in relevant laws and regulatory requirements. If we have to revise these Terms & Conditions before your attend a Fertility Wellness Retreat with us, we will contact you to give you reasonable advance notice of the changes and advise how you can cancel the contract if you are not happy with the changes.

We may also need to make changes to these Terms and Conditions due to events beyond our control that are in relation to Grassfield Hall and our other Third-Party Fertility Partner Providers.

Jurisdiction

These terms and conditions shall be governed and construed in accordance with English and Welsh law.
